One in Four welcomes Supreme Court decision overturning release of Mr. A

One in Four, the national charity which supports women and men who have experienced sexual violence, this evening welcomed the Supreme Court decision overturning the High Court order which resulted in the release of Mr. A earlier this week.

This decision will mean that Mr A will be returned to prison to serve the remainder of his sentence and his conviction for Statutory Rape is upheld. Speaking earlier, Colm O'Gorman, Director of One in Four, said, “This decision is one which will be welcomed by all with relief. It will help to restore some confidence in a Criminal Justice system which seemed incapable of dealing with the objective clear facts in this case and which threatened to allow a man who admitted the rape of a twelve year old child to walk free. The decision is a victory for justice, for common sense and for simple decency. We welcome it warmly and know that it is huge relief to the child raped by this man and her family.”

The decision of the Supreme Court that the perpetrator in this case was not entitled to a defence of honest mistake as he clearly knew the age of the child should act to clarify the law and ensure that no further releases in cases where the victim was obviously a child and the perpetrator an adult.

One in Four is calling for clarification at the earliest possible opportunity of the implications of this decision on other such cases pending in the High Court.
